Discrimination? They said they wanted someone age 28-40, but didn't need a degree associated with the age, or any level of experience. Is that considered discrimination?

not necessarily All depends on what the job is. Often if a company is marketing to a specific group, they want people in that group... hence an age group.

    Pretty much The real question is this: Is this ILLEGAL discrimination? We need more info, what position is this for, is there a BFQ for the age requirement, etc.

    Probably not If they have less than 15 employees, they can pretty much discriminate along those lines.

    Even if the target market is that age group It seems wrong to discriminate because someone is younger (as I am) or even older. And as for less than 15 employees, aren't all employers supposed to be equal opportunity if they are hiring legally? Equal opportunity means everyone has a chance.

    If only Unfortunately, the laws only apply to companies of a certain size. The smaller the company, the fewer laws that apply, even equal opportunity laws have size limits. That's just how it is.

    Additionally you don't really know if that is how one gets discriminated against. The thing is-so what. If you feel that you are not being hired for this position because of your age, you can report it to the department of labor who enforces the equal opportunities act. But it will not likely get you the job or money especially if they are a small employer. If you really want to work at this particular salon, make a compelling argument to the owner why you should be hired. Otherwise just keep looking for a job elsewhere.

    More like practical In re-reading what you posted about the job, I suspect that they have been burned in the past so decided to put the age qualification to narrow the field of applicants.

    That's what we a BFQ. A Bone Fide Qualification. The age requirement in the military is necessary. If it's necessary, then it's allowed.

    Necessary ...for whatever. BFQ's exist in all sorts of venues. In the military, you can't have 65 year old carrying 100 lbs on their backs fighting a war abroad. For SI Swimsuit Calendar models, you can't sue them for age and sex discrimination if you're a 45 year old dude with a beer gut. It's a BFQ that the job go to an attractive female. Make sense?

    You make perfect sense with those extremes but I am certain there are many in their 40s & 50s in the military pushing pencils or sitting on their butts, and probably couldn't do 20 pushups if their life depended on it. For certain combat ops, certainly the age plays a major factor for both physical and mental reasons, but there is a lot of very experienced personel that could be valuable assets. I do get your point though.

    True, but the old ones started at 18. No one started at 40 or 50, they did boot camp and everything at 18-25

    I just bet they would make exceptions if a 3rd world war broke out causing major casualties. Those restrictions would get buried, but thats how the gov't is.

    The cut off age for the military is 28 You CANNOT join if you are over 28. the people in their 50s who are military have been in since BEFORE they were 28 years old.

    Safety. And age restrictions only apply to entering the military, and they are necessary for the amount of training you do as well as being able to physiy do the jobs. They also have health requirements and physical standards. Plus, the government doesn't always follow its own laws, military has their own separate and usually more severe ones.

    Believe me the military has its own laws My husband was in the USMC for 4 years... they have their own laws. I even had my own laws. They ed them standards. I ed them stupid. Any way, sadly, just like places can have dress codes, they can have limitations on age. Looks at Abercrombie, they scout good looking thin people, just like their models. If you interview their and you're fat and balding they won't hire you, even if you look old they wont hire you. They can do that because they are marketing a product. Just like the salon is marketing hair services, ect. If you come in and your hair looks like a birds nest and you're not wearing make up, they will probably ask you to leave. No one will want to have their hair done if the front desk person looks like that. Now if this were and office and you were doing a computer job where you didn't interact with the public it would be a lot harder for the company to get away with it.
